Nursing Malpractice

Nursing malpractice results from the failure of a nurse to competently perform their duties leading to patient harm (Dahlawi et al., 2021). According to Dahlawi et al. (2021), malpractice threatens patient safety and may lead to injury, disease, disability, or death. Malpractice among nurses can occur in several areas, including technical errors during procedures, misdiagnosis, prescription, or administration of wrong medications. The subsequent paragraphs summarize an article by Croke (2006) with emphasis on the primary problems that led to malpractice and the role played by the nurse.

According to Croke (2006), malpractice is still a burden in modern-day healthcare despite enormous efforts invested in nursing education on law and professional responsibilities. Croke (2006) further highlights duty, breach of duty, foreseeability, injury, causation, and damages as aspects that cause issues that lead to malpractice. Nurses must provide holistic care to a patient. Similarly, healthcare facilities have distinct standards related to care provision that every nurse agrees to before securing employment. Consequently, intentional failure to comply with these standards is considered malpractice. This is closely linked to breach of duty. An additional aspect linked to malpractice is foreseeability. According to Croke (2006), a nurse has a responsibility to reasonably foresee potential threatening issues and thus prevent risks that may result in patient harm. On the other hand, the aspect of causation correlates nurses’ responsibilities with the consequences resulting from their actions. Finally, injury and damages are the other primary problems that may lead to malpractice.

In the case given in the article, a nurse is blamed for being guilty of a patient’s death and unprofessional. Nevertheless, the nurse claimed she didn’t have any obligations toward the patient as he was not admitted to their facility.
